1. Our Policy
Kilowatt Electrical LLC ("Kilowatt Electrical," "we," "us," or "our") respects the intellectual property rights of others and expects users of Kilowatt Portal (the "Service") to do the same. This policy explains how to submit a copyright infringement notice under the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, how we respond, and how to submit a counter-notice if your own material was removed.
This policy covers user-submitted content on the Service — including job photos, estimate and invoice attachments, and inbound message media — not content we author ourselves.
2. Submitting a Notice of Infringement
If you believe material on the Service infringes a copyright you own or control, send a written notice to the contact below that includes all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material you claim is infringing, and information reasonably sufficient for us to locate it on the Service (a URL, screenshot, job/estimate/invoice number, or similar).
- Your contact information: name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.
A notice missing any of these elements may not be actionable under the DMCA. Submitting a knowingly false or materially misleading notice can expose you to liability, including for costs and attorneys' fees, under 17 U.S.C. § 512(f).
3. Where to Send a Notice
Send infringement notices to:
Kilowatt Electrical LLC
Attn: Copyright Notices
14115 Church St, Westminster, CA 92683
Email: jovani@kilowattinfo.com
Phone: (714) 908-9602
Kilowatt Electrical LLC has filed a designated agent registration with the U.S. Copyright Office under 17 U.S.C. § 512(c)(2) (Registration Number DMCA-1082688). The filing is pending payment verification with the Office; notices sent to the contact above are handled the same either way.
4. Our Response
Upon receiving a valid notice, we will review it and may remove or disable access to the identified material, notify the user who posted it, and provide that user a copy of the notice. We may remove clearly infringing material without notice to the uploader where appropriate.
5. Counter-Notification
If material you posted was removed or disabled and you believe this was done by mistake or misidentification, you may submit a counter-notice to the contact in Section 3 that includes all of the following:
- Your physical or electronic signature.
- Identification of the material that was removed and its location on the Service before removal.
- A statement, made under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if outside the United States, any judicial district in which Kilowatt Electrical may be found), and that you will accept service of process from the person who submitted the original notice or their agent.
If we receive a valid counter-notice, we may restore the material in not less than 10 and not more than 14 business days after receiving it, unless we first receive notice that the original complaining party has filed a court action seeking a restraining order.
6. Repeat Infringers
We may terminate, in appropriate circumstances, the access of users who are determined to be repeat infringers, consistent with Section 10 of our Terms of Use.
