1. Agreement to These Terms
These Terms of Use ("Terms") are an agreement between you and Kilowatt Electrical LLC ("Kilowatt Electrical," "we," "us," or "our"). By accessing or using Kilowatt Portal or its public online-scheduling pages (the "Service"), you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. Online Scheduling and Service Visits
Online scheduling lets you request or reserve a preferred arrival window. An arrival window is an estimate and not a guaranteed start time. Project estimates, addresses outside our standard service area, urgent requests, and other exceptions require staff review and confirmation.
A standard Electrical Service Visit is listed at $175 and includes travel and up to one hour onsite during normal business hours to diagnose or troubleshoot an existing electrical problem. No payment is collected through the booking form. The $175 price does not include repairs, materials, permits, or work beyond the included visit unless stated in a separate written agreement.
An online reservation does not authorize Kilowatt Electrical to perform electrical work or incur additional charges on your behalf. Before work begins, the applicable written service, repair, or home-improvement agreement and legally required disclosures will be presented separately. That project-specific agreement controls the work and payment terms.
3. Changes, Cancellations, and Emergencies
Confirmed appointments may be canceled or rescheduled online until 24 hours before the reserved visit. Within 24 hours, call or text (714) 908-9602. We currently do not charge an online cancellation or rescheduling fee. If that policy changes, the applicable fee will be disclosed before a customer completes a future booking.
Online scheduling is not an emergency-dispatch service and does not guarantee an immediate response. For fire, smoke, active electrical shock, or immediate danger, call 911 first. For other urgent electrical concerns, call Kilowatt Electrical.
4. Limited License and Authorized Use
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Service for legitimate business and service-management purposes. The Service is provided only to Kilowatt Electrical customers, employees, contractors, and other expressly authorized users. You must provide accurate information, keep your credentials confidential, and promptly notify us of suspected unauthorized access.
5. Acceptable Use
You may not:
- Use the Service in violation of law or another person's rights.
- Access an account, record, or system without authorization.
- Interfere with the Service, bypass security controls, or introduce malicious code.
- Scrape, reverse engineer, or attempt to derive source code except where applicable law prohibits this restriction.
- Use the Service to send unlawful, deceptive, abusive, or unsolicited communications.
- Upload content you do not have the right to use or disclose.
6. Connected Services
The Service may connect to third-party products such as QuickBooks Online, payment providers, communications services, storage providers, and electronic-signature platforms. You authorize us to exchange information with a connected service as necessary to perform actions you request. Your use of third-party services is also governed by their terms and privacy policies.
You are responsible for confirming that you have authority to connect each third-party account and to provide or synchronize its data. We are not responsible for third-party services, their availability, or changes they make to their products or interfaces.
7. Customer Content and Data
You retain ownership of information and content you submit to the Service. You grant us a limited right to host, process, transmit, display, and back up that content as needed to provide, secure, and support the Service and comply with law. Our handling of personal information is described in our Privacy Policy.
8. Estimates, Invoices, and Payments
Project-specific estimates, contracts, invoices, payment terms, warranties, and disclosures are governed by the applicable documents presented for that transaction. If these Terms conflict with a signed project agreement, the signed project agreement controls for that project.
9. Availability and Changes
We may modify, suspend, or discontinue any part of the Service. We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. Features may depend on third-party platforms and network availability.
10. Intellectual Property
The Service, including its software, design, branding, and documentation, is owned by Kilowatt Electrical or its licensors and is protected by applicable intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are transferred to you.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. The Service is a business-management tool and is not legal, tax, accounting, or financial advice.
12. Limitation of Liability
To the maximum extent permitted by law, Kilowatt Electrical and its officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunities arising from use of the Service.
13. Suspension and Termination
We may restrict or terminate access if you violate these Terms, create security or legal risk, or are no longer authorized to use the Service. Provisions that by their nature should survive termination will remain in effect.
14. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be brought in a court of competent jurisdiction in California, unless applicable law requires otherwise.
15. Changes to These Terms
We may update these Terms from time to time. The revised Terms become effective when posted with a new effective date. Continued use after that date constitutes acceptance of the revised Terms.
